Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Niche Industries LLC ("Niche Industries," "we," "us," or "our") governing your access to and use of Aviation Parts Safety Alert, available at aerobriefings.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you're using the Service on behalf of an organization, you're agreeing on that organization's behalf and confirming you have the authority to do so.
1. What the Service Is
The Service monitors public FAA and NTSB safety data sources against a watchlist you configure (aircraft models, keywords, part numbers, and ATA chapters) and sends you email reports of matching records. Every item in a report links to the original official government record it was drawn from.
The Service is a discovery and monitoring tool, not a complete or authoritative source of aviation safety information. Reports are a filtered subset of what our data sources have published — records are reproduced unaltered from those sources, without synthesis, interpretation, or editorial judgment, but the absence of a match in your report is not confirmation that no relevant record exists. You are solely responsible for verifying any safety, airworthiness, maintenance, or compliance matter against the official source records themselves, and for any decision or action you take (or don't take) based on a report. The Service does not provide legal, engineering, airworthiness, or regulatory advice, and nothing in a report should be treated as such.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You're responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@aerobriefings.com if you suspect unauthorized access to your account.
3. Subscriptions, Trials, and Billing
- Free trial: new accounts start on a free trial with no watchlist limits. No credit card is required to start a trial.
- Recurring subscriptions (Individual, Group Hangar, Small Fleet, Commercial Fleet) bill monthly or annually in advance and renew automatically until canceled. You can cancel at any time from your account's billing portal; cancellation stops future billing but does not refund amounts already charged for the current billing period, except where required by law.
- Fixed-term (one-time) licenses are a single payment for a set number of months of access and do not automatically renew. They are non-refundable once purchased, except where required by law.
- Enterprise subscriptions are invoiced individually under terms agreed with our team, which control over any conflicting provision in these Terms for that account.
- All fees are exclusive of applicable taxes unless stated otherwise; taxes are calculated and added at checkout where we're required to collect them.
- We may change our prices for future billing periods with reasonable advance notice; changes won't apply retroactively to a period you've already paid for.
4. Watchlist Limits
Each subscription tier caps how many keywords, part numbers, aircraft models, and ATA chapters you can watch, as described on our pricing page. Limits are enforced when you add or modify watchlist items; a plan change may require trimming your watchlist to fit the new tier's limits.
5. Referral Program
If we offer a referral program, it works as described on your account dashboard at the time: you receive a personal referral code to share, and if someone you refer signs up and converts from trial to a paid subscription, we may send you a reward (such as a gift card) at our discretion. Referral rewards have no cash value, cannot be transferred or resold, and we may modify, suspend, or end the referral program, or decline a reward we reasonably believe was obtained through fraud or abuse, at any time.
6. Acceptable Use
You agree not to:
- Use the Service to violate any law or the rights of any third party;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Scrape, reverse engineer, or systematically extract data from the Service, or resell or redistribute report content as a standalone data product;
- Interfere with or disrupt the integrity or performance of the Service;
- Use another person's account without permission, or misrepresent your identity or affiliation.
We may suspend or terminate access for any account we reasonably believe violates this section.
7. Intellectual Property
The Service, its software, design, and branding are owned by Niche Industries LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own internal business purposes during your subscription. You retain all rights to the watchlist configuration and any content you submit to us (such as feedback); you grant us a license to use it solely to provide and improve the Service. Underlying government records referenced in reports remain public information from their original sources and are not owned by us.
8. Disclaimer of Warranties
THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF DATA. We do not control, and are not responsible for, the accuracy, completeness, or timeliness of the underlying FAA, NTSB, or other government data sources our reports are drawn from. We do not warrant that the Service will be uninterrupted, error-free, or that it will catch every record relevant to your watchlist.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHE INDUSTRIES LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION MADE OR ACTION (OR INACTION) TAKEN IN RELIANCE ON A REPORT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions don't allow certain limitations on liability, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold Niche Industries LLC harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.
11. Termination
You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms, or with reasonable notice for any other reason. Sections that by their nature should survive termination (including Sections 7–10) will survive.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you directly. Continued use of the Service after a change means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona, and you consent to that jurisdiction and venue.
